MusicFestivalSuite was first created because the High River and District Lions Music Festival (now known as the Highwood Lions Music Festival) used a different software that experienced a significant privacy breach, affecting every person involved in the Festival in 2011. It led to the creation of MusicFestivalSuite.
MusicFestivalSuite, therefore, works intensely hard to stay on top of legislation and industry standards where your personal information and privacy are concerned. To that end, we employ the following Privacy Policy, most recently updated on September 30, 2024.
# PRIVACY POLICY
## SECTION 1 - WHAT DO WE DO WITH YOUR INFORMATION?
When you participate in any of our subscribing Festivals, we collect the personal information you give us such as your name, address and email address.
With your permission, a subscribing Festival may prompt an email to be sent to you through an email account on the MusicFestivalSuite domain created exclusively for use by the subscribing Festival for the purposes of operating their Festival.
## SECTION 2 - CONSENT
When you provide us with personal information to create a Profile with MusicFestivalSuite, you provide express consent to our collecting it and using it for that specific reason only in accordance with appropriate federal, provincial and local privacy and electronic communications legislation.
As part of creating your Profile and annually thereafter, you are required to complete a “Photographic and Identity Consent, Release and Waiver” form providing or denying consent for the subscribing Festival, and by extension MusicFestivalSuite, to use and display photograph(s), film(s) and audio/video recording(s) of you submitted to MusicFestivalSuite solely for the purposes of operating that subscribing music Festival. You can revoke, provide, or change consent at any time from within your Profile to use and display photograph(s), film(s) and audio/video recording(s) of you at any time.
After you create a Profile you may withdraw your consent for us to contact you by logging into your Profile and choosing the “Deactivate” option in your Profile. Alternatively, you can request we remove you from promotional electronic communications by emailing your local Festival organization that subscribes to MusicFestivalSuite asking to Deactivate your Profile, or choosing the one-click Unsubscribe link at the bottom of any promotional email sent to you on behalf of your local Festival. Unsubscribing in this way does not prevent the delivery of transactional emails connected to registrations or financial transactions that remain active.
## SECTION 3 - DISCLOSURE
Your data is not ours to disclose. The Festival who subscribes to MusicFestivalSuite with whom you have created a Profile is the custodian of the data. We may only disclose your personal information if we are required by law to do so or if you violate our Terms of Service.
Your data is stored on Canada-based servers, and at no time is your information disclosed, exported or otherwise distributed to any third-party application, software or organization. This data is stored on a secure server behind multiple redundant firewalls using a proprietary encoding system. Subscribing Festivals only have access to your personal information for the purposes of operating their Festival through MusicFestivalSuite, and at no time is your personal information able to be exported to other data storage mechanisms.
Should you provide information required to link your Profile to any other individual (either as a Parent/Guardian, Teacher/Group Leader, or Accompanist), you are consenting to the disclosure of your name and contact information to those individuals and only those individuals linked to your Profile.
At no time does MusicFestivalSuite collect your credit card data, personal financial details, or login credentials to third-party payment solutions. MusicFestivalSuite collects only the data required to mark a registration as paid and when that payment was received. MusicFestivalSuite relies on the third-party Stripe to process those transactions, and will never collect your personal financial data nor your login credentials to such a third-party.
All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express, Discover, Google Pay and Apple Pay.
At no time is your data distributed to any third-party source by MusicFestivalSuite, and we also make every effort to prevent any of your data from being transmitted outside of Canada, therefore preventing your data from being subject to the Patriot Act of the United States of America or any other legislation from any other country that would enable legal interception of your personal data.
As we are not the custodians of your data, we are not responsible for the security and privacy of your information posted on any other site, even if such a link originates from the information you provide to your MusicFestivalSuite Profile. This includes our subscribing Festivals’ websites and YouTube.
## SECTION 4 - SECURITY
To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.
Although no method of transmission over the Internet or electronic storage is 100% secure, we follow and exceed requirements as outlined by various federal and provincial legislations, including the Privacy of Information and Protection of Electronic Documents Act, Canada’s Anti-Spam Legislation, the Personal Information Protection Acts of Alberta and British Columbia, and Quebec’s Privacy Act.
## SECTION 5 – ARCHIVING OF PERSONAL INFORMATION
After no more than 3 festival seasons of inactivity, your information enters into our archival processes. Your information is removed from the active components of MusicFestivalSuite and subsequently removed from our servers. Your personal information no longer becomes available for Subscribing Festivals to use without your express consent, as it no longer resides on our servers. In this manner MusicFestivalSuite protects your personal information even when you are no longer actively using your MusicFestivalSuite Profile.
## SECTION 6 - AGE OF CONSENT AND WARRANTIES
By using this site you warrant that any and all information provided is a true and accurate representation of you as the real human using MusicFestivalSuite services.
By creating and confirming a Profile as an performer's Teacher/Group Leader, you warrant that you accept responsibility for understanding the syllabus, rules and regulations of the Festival, and that you will ensure any registrations linked to your Profile adhere to the syllabus, rules and regulations. Additionally, by allowing a Group performer to be connected to your Teacher/Group Leader Profile, you represent that you have collected the appropriate Photographic and Identity Release, Consent and Waivers on behalf of the Festival when you complete the Photographic and Identity Release, Consent and Waiver forms within MusicFestivalSuite.
By creating and confirming a Profile as an performer's Parent/Guardian, you warrant that you are the legal guardian of any Entrants who are the age of minority in your state or province linked to your account, and that you expressly consent to their participation in the Festival and the use of their information in accordance with the aforementioned privacy legislations and policies.
Any intentional misrepresentation or inaccuracy in your Profile will result in the suspension of your Profile through MusicFestivalSuite's Deactivation and Freezing processes, and may also result in the removal of any registration associated with your Profile. It may also result in the suspension of linked Profiles. You are liable for any costs associated with the suspension of your Profile and/or the suspension of any linked Profiles as a result of your Profile's suspension. You also accept the responsibility for the contravention of any privacy legislation and/or policy resulting from your intentional misrepresentation or inaccuracy in your Profile.
## SECTION 7 - CHANGES TO THIS PRIVACY POLICY
We reserve the right to modify this Privacy Policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. If we make material changes to this policy, we will notify you by way of updating the “last updated” that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it. Wherever a link is available to this policy, the “last updated” date will change.
## QUESTIONS AND CONTACT INFORMATION
If you would like to access, correct, amend or delete any personal information we have about you, we direct you to do so from within the Profile you created with the Festival with which you identify. If you wish to register a complaint or simply want more information, submit a Support Ticket from within your Profile to contact your local Festival with which you identify. As your local Festival is the custodian of your information, they will address your concerns directly and involve MusicFestivalSuite only when necessary.
